Defending Indiana Individuals From Unfair Credit Reporting
The federal government enacted the Fair Credit Reporting Act (FCRA) to help ensure that the information credit bureaus or consumer reporting agencies have on file for you is accurate, fair and private.
At the Law Office of Weiss & Schmidgall, P.C., our Merrillville federal Fair Credit Reporting Act attorneys can both explain your legal rights and help enforce those rights. Don't try to fight the credit bureaus on your own — get one of our experienced Indiana lawyers on your side.
Some of Your Credit-Related Rights
You may seek damages from any consumer reporting agency that violates the FCRA. In addition:
- You have the right to ask for your credit score. You have the right to a free credit report from each nationwide credit bureau every 12 months.
- You have the right to view information in your file. A consumer reporting agency must disclose all the information in your file at your request.
- You must be informed if data in your file was used against you. If an application was denied because of information in your credit report, you have the right to know the name, address and phone number of the consumer reporting agency that gave out that information.
- You may dispute inaccurate information. If your file contains incomplete or inaccurate data, you have the right to have the agency investigate the facts.
- Agencies must correct false information. The consumer reporting agency must correct any information proven to be incomplete, unverifiable or inaccurate.
- Agencies must not report outdated information. In many cases, consumer reporting agencies are not allowed to report bankruptcies that happened more than 10 years ago or negative events that happened more than seven years ago.
